Recent Cases and Decisions of Interest

• Florida Supreme Court Amendment 7 Decision
  The Florida Supreme Court's decision in Florida Hospital v. Waterman, 33 Fla. L. Weekly S154, March 6, 2008, holding Amendment 7 to be self-executing, retroactive and applicable to records existing prior to its passage. A motion for rehearing was denied May 12, 2008.
• 3DCA opinion holding HMO liable for nonpar services
  April 16, 2008, Third District Court of Appeal opinion holding HMO liable for services provided by non-participating providers. The Health Law Section thanks Gary Walker of Allen Dell, PA, Tampa, for bringing this opinion to the Health Law Section's attention.
