January 2009 Executive Council Meeting and CLE Program
The next Executive Council meeting of the Health Law Section is scheduled for Thursday, January 15, 2009 in conjunction with The Florida Bar Mid Year Meeting at the Miami Hyatt.
The executive council meeting will be held from 3:30 p.m. - 5:30 p.m. and will be followed by a Health Law Section Member Reception.
Following the reception, a dinner is planned for speakers of Representing the Physician and members of the executive council.
Mark your calendars and let Valerie Yarbrough know if you plan to attend the dinner or the meeting.

Per Medicare transmittal 248 issued in March 2008, effective September 30, 2007, Medicare requires a legible identifier for services provided/ordered. The method used shall be hand written or an electronic signature. Stamp signatures are not acceptable to sign an order or other medical record documentation for medical review purposes.

Rehearing denied: First DCA holds in Custom Mobility case that AHCA's cluster sampling formula is not an unpromulgated rule
In a September 4, 2008, opinion, the First District Court of Appeal held that AHCA's cluster samplying formula used to calculate Medicaid overpayments is not an unpromulgated rule. 1 DCA Case Number 07-4608. Rehearing denied November 6, 2008. To see a copy of the September opinion, click here.
Constitutional challenge to Amendment 7
A federal lawsuit was filed July 10 in the US District Court in Tallahassee seeking declaratory and injunctive relief barring enforcement of Amendment 7 as violative of the US Constitution. Click here for a copy of the 40-page complaint.
The FHA and numerous parties are asking the court to rule that Amendment 7 conflicts with federal statutes governing the medical review process, and violates constitutional rights to privacy, due process, and impairs obligations of existing contracts.
