Constitutional challenge to Amendment 7
A federal lawsuit was filed July 10 in the US District Court in Tallahassee seeking declaratory and injunctive relief barring enforcement of Amendment 7 as violative of the US Constitution. Click here for a copy of the 40-page complaint.
The FHA and numerous parties are asking the court to rule that Amendment 7 conflicts with federal statutes governing the medical review process, and violates constitutional rights to privacy, due process, and impairs obligations of existing contracts.
